1. ACCEPTANCE OF TERMS

MILOL provides the information on this Web site as provided in these Terms of Service ("TOS"). MILOL may update the TOS at any time and without prior notice by posting a new version at http://www.milol.com/terms.html. The information on this site and your use of it is subject to the most recent version of the TOS posted.

2. DESCRIPTION OF SERVICE

MILOL provides you with access to this site, e-commerce, and other services. Unless explicitly stated otherwise, any new features that augment or enhance the current MILOL Service shall be subject to the TOS.

3. YOUR REGISTRATION OBLIGATIONS

In consideration of your use of the MILOL Service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to:
(a) provide true, accurate, current and complete information about yourself as prompted by the MILOL Service's registration form (the "Registration Data") and
(b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or MILOL has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, MILOL has the right to suspend or terminate your account and refuse any and all current or future use of the MILOL Services (or any portion thereof).

4. PRIVACY POLICY

Registration Data and certain other information about you is subject to our Privacy Policy.

Types of Information We Collect

4.1 Personally Identifiable Information (“PII”):

When you join our emailing list to receive our newsletters and other communications via email we collect your email address. We also collect PII that you choose to give us in your communications with us.

4.2 Aggregate and Anonymous Information (“AAI”):

We also collect aggregate and anonymous information (“AAI”) on the Site. AAI cannot identify or be linked to a specific individual. For example, we collect user traffic data and total page views in a given time period, average amount of time users spend on the Site, how many times a particular piece of content on the Site was viewed or downloaded by our users, etc. We may also combine information about individual users to generate aggregate data that reflects activities, habits, preferences, interests, etc. about our users as a group.

4.3 User Activity Information (“UAI”):

In addition, we collect certain user activity information (“UAI”) on the Site. For example, our Site servers automatically collect and log “clickstream data” for all visitors to the Site, such as IP addresses (which are numerical numbers that are automatically assigned to users’ computers and mobile devices when they are surfing the Internet), page requests, pages visited, content viewed, clicks and search queries made, etc. If and to the extent we use any UAI in a manner that identifies a specific user individually (e.g., if we link or associate such information with a specific user), it will be treated as PII. Otherwise, all UAI will be treated as AAI.

4.4 Information Access & Opt –Out

If you have provided PII to us, you can request to access and update your information by going to your account page or via email at customerservice@milol.us and make your request and provide any necessary information.

4.5 Data Retention

We will retain your PII for as long as your account on the Site is active or as needed to provide you products or services, and as necessary to comply with our legal obligations, resolve disputes, and/or enforce our agreements. AAI and UAI (if not personally identifiable) may be retained indefinitely.

4.6 Protecting Children

MILOL takes the safety and privacy of children seriously. We do not knowingly collect or solicit personal information from or about users under age 13 through our website. Children under age 13 should always ask their parents or guardians for permission before providing any personal information to anyone online or through mobile devices. If you are a parent or legal guardian, we urge you to participate in your child’s online activities and to use parental control or other Internet filtering technology to supervise your child’s access to the Internet. If you are under 18 years of age, please do not submit any personal information through our websites without the express consent and participation of a parent or guardian.

4.7 Cookies and Similar Technologies

The Site might uses “cookies.” A cookie is a small amount of data that is sent to your browser from an internet server and stored in your computer. Generally, we use cookies to remind us of who you are, tailor our content, products and services to suit your personal interests, estimate our audience size, process your requests and comments, and/or to analyze your visiting patterns. Protecting the security of PII that you share with us is important to us. Unfortunately, however, no data transmission over the Internet or any mobile or wireless network and no data storage can be guaranteed to be 100% secure. As a result, while we strive to protect your PII, we cannot guarantee or warrant the security of any information you transmit to or from or on the Site, and you do so at your own risk. By providing your email address to us, you acknowledge and agree that we may notify you by email in the event of a breach of security involving your PII.

5. CONDUCT

You understand that all information, data, text, software, graphics or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not MILOL, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the MILOL Service. MILOL does not control the Content posted via the MILOL Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will MILOL be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the MILOL Service.

6. INDEMNITY

You agree to indemnify and hold MILOL and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including but not limited to reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the MILOL Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

7. MODIFICATIONS TO MILOL SERVICE

You acknowledge that MILOL may establish general practices and limits concerning use of the MILOL Service. You further acknowledge that MILOL reserves the right to modify these general practices and limits from time to time. MILOL reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the MILOL Service (or any part thereof) with or without notice. You agree that MILOL shall not be liable to you or to any third party for any modification, suspension or discontinuance of the MILOL Service.

8. TERMINATION

You agree that MILOL may terminate your access to the MILOL Service for violations of the TOS and/or requests by authorized law enforcement or other government agencies.

9. LINKS

The MILOL Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because MILOL has no control over such sites and resources, you acknowledge and agree that MILOL is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that MILOL shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

10. DISCLAIMER OF WARRANTIES

You expressly understand and agree that: Your use of the MILOL service is at your sole risk. MILOL service is provided on an "as is" and "as available" basis. MILOL and its subsidiaries, affiliates, officers, employees and licensors expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. MILOL and its subsidiaries, affiliates, officers, employees and licensors make no warranty that
(i) The MILOL service will meet your requirements;
(ii) The MILOL service will be uninterrupted, timely, secure or error-free and
(iii) The results that may be obtained from the use of the MILOL service will be accurate or reliable. No advice or information, whether oral or written, obtained by you from MILOL or through or from the service shall create any warranty not expressly stated in the TOS.

11. LIMITATION OF LIABILITY

You expressly understand and agree that MILOL and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if MILOL has been advised of the possibility of such damages), resulting from the use or the inability to use the MILOL service.

You expressly understand and agree with Open Source licences for any MILOL service or/and MILOL product that provide Open Source's software.

Hardware Support

The following are special terms applicable to your hardware warranty.

MILOL One Year Limited Hardware Warranty Terms

Replacement, Repair or Refund Procedure for Hardware:

MILOL's one (1) year warranty obligations are limited to the terms set forth herein. MILOL warrants elegible products against defects in materials and workmanship under normal use for a period of ONE (1) YEAR from the date of purchase. If a hardware defect arises and a valid claim is received within the Warranty Period, at its option and to the extent permitted by law, MILOL will either (1) repair the hardware defect at no charge, using new or refurbished parts that are equivalent in performance and reliability, (2) exchange the product with a product that is new or refurbished that is equivalent in performance and reliability and is at least functionally equivalent to the original product, or (3) refund the purchase price of the product.

MILOL may request that you replace defective parts with new or refurbished parts that MILOL provides in fulfillment of its warranty obligation. When a product or part is exchanged, any replacement item becomes your property and the replaced item becomes MILOL's property. Parts provided by MILOL in fulfillment of its warranty obligation must be used in products for which warranty service is claimed. When a refund is given, the product for which the refund is provided must be returned to MILOL and becomes MILOL's property.

MILOL will use reasonable efforts to ship a replacement part or product within ten (10) working days after receipt of the RMA request. Actual delivery times may vary depending on Customer location.

MILOL reserves the right to refund the purchase price as its exclusive warranty remedy.

All third party hardware retains its original Limited Warranty from the manufacture. Customers have the choice of use either MILOL One Year Limited Hardware Warranty for elegible products or third party Hardware Warranty directly from the manufacture.

30-Day Money Back Guarantee

We offer a 30-day money back guarantee on all MOC Systems hardware, accessories, and peripherals . If you are unsatisfied with your product for any reason you may return it within 30 days for a 100% refund. Shipping and handling fees are not refundable. A replacement fee of $50 to $100 will be assessed if scratches or damage are present on desktop panel(s). To return the purchased product, you must obtain a Return Materials Authorization number. You must ship the purchased product within Seven (7) days of receiving your RMA number. Moreover, you must also return the purchased product to MILOL in its/their original packaging, in as-new condition along with any media, documentation, and all other items that were included in the original shipment.
